Further to the technical alert issued on 18 February 2021, Companies House has provided clarification to the rejection of Form LIQ03, Give notice of progress report in voluntary winding up.

The examiners at Companies House are encouraged to reject documents only where there are “unnecessary materials” which are in clear breach of GDPR regulations. In this particular instance, a decision was made to reject the documents filed as they contained specific details of the virtual meeting, including the access PIN, which they consider were not suitable to go on the public record and were identified as a potential breach of sensitive information.

Companies House acknowledged that the type of detail mentioned above may have been missed in the past or by a less vigilant examiner. Furthermore, even if the presenter submitting the documents was happy for such information to go on the public record, Companies House must remain as consistent as possible in their examination policy, regardless of the presenter.

Companies House has recommended that if your documents are regularly formatted to include this type of information (e.g. access PIN), they suggest either removing the information or applying a notice above the information to identify as suitable to be placed on the public record to avoid the filling being rejected in the future.
